Published on April 23, 2014, it is not expected that the process will be completed before the beginning of next year. The aim of the remote gambling law is to provide uniform standards for South African online gambling . According to the draft Bill, the legislation will require Internet gaming providers to receive a remote gambling license in order to operate online. These licenses would be issued by the National Gambling Board. The applications would need to be made to the provincial licensing authority and operators would be required to maintain some of their remote gambling equipment in the province where they made the application. The taxes collected on gambling revenue will be distributed with 30 percent going to the national revenue fund and 70 percent to the provincial revenue fund with each province responsible for imposing a tax rate on operators. South African players will be able to legally play at licensed remote gambling sites and players residing outside South Africa will also be able to play as long as they have registered as a player on the site. Remote gambling would include virtual gambling games, person-to-person gambling, equal chance gambling and casino games, bingo and sports betting. Remote gambling will need to comply with the Financial Intelligence Center Act and it would put measures in place to protect minors from the negative effects of gambling.     In the 2006/2007 financial year licensed gross gambling revenue as monitored by the National Gambling Board totalled R13.52 billion, from R11.4 billion the previous year. 86.2 percent of that revenue was derived in casinos. [5] In the same period the Board reported a total of 455 raids on and closures of presumed illegal gambling operations. [6]

    South Africa’s gambling revenues are projected to rise to R30 billion in 2019, according to a new report. The South African gambling industry – including casinos, sports betting, the National Lottery, limited payout machines and bingo – achieved gross gambling revenue of R26.3bn in 2016.

    39. How does gambling affect society? For example, in most cases parents go to gambling areas with children, how does this affect families? First, as regulators, we do acknowledge that gambling has negative effects on society as a whole. However, there are mechanisms in place to counter any such problems. In South Africa specifically, we have a National Responsible Gambling Programme (NRGP) which deals with problem gambling tendencies, counseling, treatment and education are provided at no cost to the public. It is regarded, internationally, as the most progressive and the best. We have mechanisms in place to ensure that a person developing problem gambling tendencies and or his/her family excludes themselves from participating in any one of the gambling activities offered nationally; We acknowledge the positive contributions that gambling has brought, through the regulation of gambling, as many jobs have been created in the economic sphere. For instance, within the casino industry alone, more than 100,000 jobs are in place since the legalisation of gambling in the country. It is also a condition precedent that licensed entities should ensure that they carry out their community social responsibilities by investing within the territories they are licensed in. To this end, we have had numerous upliftment programmes nationally that can be accounted for an example, the building of schools, halls etc. With regard to issues around the abandonment of children at casinos, regulators do not take kindly to such behavior. It in fact, may be a warning to the said casino that the parent is developing problem gambling tendencies and they need to be assisted.
    40. What are the levels of gambling compliance within the African continent? While members all strive for strict compliance monitoring and enforcement, not all states have developed enabling legislations that would ensure that illegal elements do not operate in such jurisdictions. Consequently, levels of compliance differ from jurisdiction to jurisdiction. However, the intention is to ensure that all adhere to best practices and uniform guidelines governing gambling.

    The National Gambling Policy Council meeting was held on 12 March 2018 in Kempton Park, Gauteng, to discuss issues affecting the gambling industry. It has considered the draft National Gambling Amendment Bill and the two Gambling Regulations amongst other issues discussed.

    The Council is constituted by Minister of Trade and Industry, Rob Davies, and the provincial MECs of Economic Development responsible for casinos, racing, gambling and wagering in the provinces and other members that include the chairpersons of the provincial licensing authorities.

    The Council considered and noted the draft National Gambling Amendment Bill. The Bill will be formally introduced before Parliament for the public hearings which will culminate with the changes to the Bill or rejection of the Bill. The National Gambling Amendment Bill was published in October 2016 and will enhance the regulation of gambling in the country. Some of the proposals include the repositioning of the National Gambling Board (NGB) to become the National Gambling Regulator (NGR) led by the Chief Executive Office. The NGR will assume the functions of the NGB.

    According to the Bill, money forfeited as unlawful winnings should be automatically forfeited to the NGR after the investigation into the legality of the gambling activity, legality standing of the punter and exclusion status. Enforcement capacity of the Regulator will be enhanced by the inspectorate operating with the NGR to fight unlawful gambling practices including online gambling. The Gambling Amendment Bill also provides that the NGR should keep a register of illegal gambling operators.

    The Council also noted the two Gambling Regulations that will be published for broader public comments as required in terms of section 87 of the National Gambling Act of 2004. Regulation 2 deals with the exclusion register that will remove certain provisions which make the registration process tedious and unnecessarily long.

    The amendment will culminate to the enhanced implementation of the national register of excluded persons. It will also include that a digital photograph of excluded person be acceptable. The amendment further requires the NGB to capture the exclusion within 10 days of receiving the form from the provinces.

    Regulation 8(4) prescribes the re-certification period for gambling machines. The regulation requires that the machine and devices be re-certified within 12 months after the date on which the regulation amendment is published and every six years after the last recertification of the machine or device.
